General Terms and Conditions for Commission Sales
In addition to the General Terms and Conditions of BOGA LUXURY BAGS, the following special conditions apply.
1. Contractual partner, conclusion of the contract
The contract is concluded with BOGA LUXURY BAGS (hereinafter referred to as 'consignor').
The contract is concluded when the owner of the product (hereinafter referred to as the 'consignor') accepts the GTC for commission sales.
2. Subject of the commission sale
The Consignor and the Consignee agree on a payment price for the goods on consignment for the Consignee before the conclusion of the contract, and the Consignee guarantees that he is the legal owner of the goods handed over to the Consignor.
3. duration of the contract
The contract is concluded for an indefinite period, but is valid for at least 30 days. It can be cancelled by either party with a notice period of 14 days to the end of the month. The cancellation can be sent by email to contact@bogaluxurybags.com
After termination of the contract, the commission agent must hand over the goods still in his possession to the principal.
4. handover and safekeeping
The commission goods shall remain the property of the principal until they are resold by the commission agent in accordance with the provisions of this contract. The commission agent is obliged to store the goods on commission carefully and separately from other goods and to protect them from damage and loss. The commission agent is obliged to adequately insure the goods on consignment in transit and in storage and to inform the principal immediately in the event that third parties gain access to the goods on consignment.
The commission goods shall remain in the commission agent's custody for at least one month after arrival and may thereafter be reclaimed by the principal after timely cancellation (see 3).
5. Duties and obligations of the commission agent
The commission agent sells the goods on commission in his own name on behalf of the principal. The goods on commission are sold and handed over to the respective buyer exclusively against prepayment.
The commission agent shall act in accordance with the instructions of the principal, who shall determine the price at which the commission goods are to be sold. This shall be done at the contractually agreed minimum prices. The commission agent shall keep the name of the principal secret from the purchaser unless the principal agrees to this.
6. Commission
The commission agent shall receive a commission of the respective contractual sales price for the completed sale. The commission amounts to
30% of the contractual sales price for a bag worth up to €5,000.
25% of the contractual sales price for a bag worth between €5,001 and €15,000.
20% of the contractual sales price for a bag worth more than €15,000.
No commission is due if the transaction does not materialise. This also applies to the buyer's right to return the item within the period stated in the BOGALUXURYBAGS website 'Terms and Conditions'.
The commission agent will pay the proceeds of the sale of the commission goods to the principal within 10 working days of the expiry of the customer's right of cancellation, less the commission and the shipping costs excluded from the contract.
7. Liability
The sender is liable as long as the goods are stored at BOGA LUXURY BAGS or transported to/from BOGA LUXURY BAGS.
8. DAC7 Implementation Act
In accordance with the DAC7 Implementation Act, the principal must provide all requested customer master data. If the data is not provided, BOGA LUXURY BAGS reserves the right to refuse to accept a commission transaction - or to delay payments due - until the data is submitted
